NEW DELHI: Congress president Rahul Gandhi Tuesday criticised the arrest of scribe Prashant Kanojia and the editor and the head of a Noida-based TV channel, saying Uttar Pradesh Chief Minister Yogi Adityanath is behaving “foolishly” and he should release the journalists.Gandhi also claimed that if every journalist who files a false report or peddles fake, vicious RSS/BJP sponsored propaganda about him is put in jail, most newspapers or news channels would face a severe staff shortage.
“The UP CM is behaving foolishly and needs to release the arrested journalists,” the Congress president tweeted.Kanojia, Anuj Shukla, who is the editor of Noida-based TV channel Nation Live, and its head Ishika Singh, have faced police action over the release of alleged objectionable content against the UP chief minister.
Other side The Supreme Court today ordered the immediate release of journalist Prashant Kanojia on bail following his arrest by the Uttar Pradesh police for allegedly sharing an objectionable post about Chief Minister Yogi Adityanath.“Liberty of a citizen is sacrosanct and non-negotiable. It is guaranteed by the Constitution and it cannot be infringed,” Justice Indira Banerjee said, while criticising the UP police for arresting the journalist for an allegedly inflammatory and defamatory tweet.
Noting that, prima facie, no case had been made out of depriving anybody’s liberty, the two- judge bench of the Supreme Court, comprising Justices Banerjee and Ajay Rastogi, criticised the Magistrate for Kanojia’s 11-days judicial remand but allowed the police to proceed against the journalist in accordance with the law.“Though we don’t appreciate such tweets, how is the arrest justified?” Justice Banerjee asked the Additional Solicitor General who appeared for the State of Uttar Pradesh.Jagisha Arora, Kanojia’s wife, had approached the Supreme Court against the alleged illegal detention of her husband at the instance of the Uttar Pradesh Police for posting a tweet about Uttar Pradesh Chief Minister Yogi Adityanath.
